Israel Commissioner of Patents: Machine Cannot Be Inventor nor Assignor of a Patent Application

Israel joins US, EPO and UK's Positions, according to which machines cannot be considered inventors or owners of patents or patent applications.

 

On March 15, 2023 the Israel Patents Commissioner rendered a long-awaited decision in the matter of DABUS, ruling that a machine cannot be deemed an inventor or owner of a patent. The decision serves to confirm the previous ruling of the patent examiner, albeit with differing grounds. By issuing this verdict, the Israel Patents Office aligns itself with other prominent intellectual property bodies, such as the USPTO and EPO, who have also maintained this position.
